Introduction
We are a research and advisory firm that helps technology companies achieve profitable growth. Industry professionals use our services to solve their top business challenges, find actionable data points, board-ready insights, etc. Our privacy policy applies to any member, non-member, or visitor to the covered services.
The following statement outlines the privacy policy of the Technology & Services Industry Association and its affiliated entities, and events (hereafter collectively "TSIA"). Please forward any comments or concerns you may have regarding this policy to privacy@tsia.com.
Our registered users ("members" and "non-members") share their professional identities with TSIA, engage with our network of member companies, exchange knowledge and professional insights, and view and download relevant content. Content on some of our services is available to non-registrants ("visitors").
Our Sites
TSIA uses multiple websites (tsia.com, technologyservicesworld.com, and productnextsummit.com) (hereafter, collectively “Sites”) and a mobile application (“App”) to deliver various forms of information and services (collectively, “Services”). TSIA provides these Services in accordance with the statements made here, supplemental privacy statements, and/or a Privacy Policy of their own. Please read the App- or Site-specific Privacy Policies or supplemental statements of each of the Services.
Our Services
TSIA understands that your privacy is important to you, and we are committed to respecting your privacy and protecting your information. This Privacy Policy applies to personal information TSIA collects in connection with fulfilling membership benefits, and providing the most relevant content to members, non-members, and visitors. It covers the collection and use of information from any device used to access or connect to TSIA branded services ("TSIA services"), which include the websites tsia.com, my.tsia.com, technologyservicesworld.com, and related microsites (the "Sites"); apps; live events such as conferences and webinars; and any enabling third-party systems.
This Policy summarizes the types of personal information we collect, and how we use, safeguard, gain access to, and update or correct personal information. Also summarized is how we resolve disputes relating to our privacy practices, and the circumstances in which we may disclose personal information.
1. Individual Privacy Rights
1.1 Right of Access and Rectification of Your Personally Identifiable Information (PII)
You have the right to access the PII about you that TSIA possesses, for instance to make updates to it. Most changes to your PII can be made from your profile/preferences pages on our Sites. For any information that you cannot change, please email privacy@tsia.com and we will make that change within 72 hours. Your identity must be verifiable via email or phone.
1.2 Right to Object to Processing PII
In addition to changing your PII, your profile provides you a means to opt out of receiving marketing communications from TSIA. You have the right to reject the processing of your PII except where processing is required by applicable law, or, where TSIA has a need to process it and processing is permitted by applicable law. Most communications have a means to opt out defined in them. If there is no means, contact privacy@tsia.com, write to the address provided below, or call TSIA to opt out. Administrative and contractual emails about your account and services may still be sent.
1.3 Right Not to Provide Consent or to Withdraw Consent
TSIA may rely on your consent to collect certain PII or use it in the way described in this Privacy Policy, in supplemental privacy statements, or in App- or Site-specific Privacy Policies. Where we rely on your consent, you have the right not to consent, and if you have provided consent, you have the right to withdraw your consent. The withdrawal of your consent does not affect the lawfulness of TSIA’s use of PII before you withdrew consent. Moreover, TSIA may have other bases, permitted or required by law, to preserve or continue using your PII.
1.4 Right of Erasure
You may have the right to have any PII removed from TSIA’s systems, although such removal may mean that TSIA can no longer provide services to your user account. For instance, if you are no longer a user of TSIA’s Services and thus it is no longer necessary for TSIA to use your PII, you may ask that TSIA erase any PII about you.
1.5 Right to Restrict Processing
You may have the right to ask that TSIA restrict use of your PII in certain circumstances, such as your belief that collection or use of the PII was not lawful, and where TSIA has a legal reason under which it is required or permitted not to erase such PII. In this circumstance, TSIA will maintain the PII in confidence and segregate it to prevent further use until TSIA is able to erase it.

2. Information We Collect
We collect only basic contact information and not payment or healthcare information.
We collect PII including basic contact information (see paragraph 2.1 below), preferences regarding communication and research areas, online behavior and use of our services. See "How We Use Your Information" (Section 3) for further details. We do not collect payment (credit or debit card) information or healthcare-related information. When individuals pay us using a payment card, we do not have access to card information.
2.1 Personal Information You Provide to Us

Ways in which PII might be provided to TSIA
Depending on your interactions with us your PII may include:
- By registering for access to our Sites, App and Services, or a conference, webinar, or free resource (i.e., any form submission where you provide additional information above and beyond the information listed in number 1 above).
- Submitting a form on our Sites or App including: contact, asset download.
- Submitting a complaint or dispute to us in conjunction with data/privacy issues outlined below in the section titled “EU-U.S. Data Privacy Framework Principles and Dispute Resolution”.
- Emailing any TSIA employee for assistance.
- Identifying yourself, beyond an anonymous inquiry, via any other means, such as in-person meeting, phone or postal mail.
Data Collected Through Downloading Content Using a TSIA Service
Some content on our website is accessible for non-members and visitors to download. In order to access this restricted content, you must fill in a form to let us know who you are. Information you supply could include, but is not limited to, your full name, email address, job title, name of employer, and phone number. The majority of TSIA content is available only to members who have registered through our website or verified conference attendees. To access this content, you must complete the website registration process, or follow instructions provided after registering for our conference.
When Registering for an Account
To register an account with TSIA, you must provide data including your full name, email address, and choose a password. You will also be asked to identify your top research areas of interest and content consumption preferences. TSIA will use your indicated interests to communicate with you via email on monthly research updates, and bi-monthly regarding opportunities to participate in research. You may update these preferences in the notification center of the TSIA Portal.
As part of the registration process, TSIA members have the ability to invite their team members to create their own individual accounts on the TSIA website by entering the email address(es) of colleagues, or uploading a list. By making use of this service, you are agreeing that you have permission to share the email addresses provided and that they have been obtained in a manner compliant with applicable anti-spam laws, including the federal CAN-SPAM Act. If these email addresses are new to the TSIA database, we will only use the addresses to send an invitation email to invite your colleague to register. If the email address(es) are already part of the TSIA database, the address(es) will be used to invite your colleagues, as well as maintain the email preferences already established by the individual.
Through Conferences and/or Events
We collect similar information as above from persons interacting with TSIA at a trade shows, conferences, summits, or other events in which TSIA is hosting or participating. When your badge is scanned or you supply a business card, the information you provide will be added to our customer relationship management system. Our Membership Development team may conduct follow-ups with this information.
If you provide a TSIA staff member your business card, we may follow up with you.
Through Online Payments
For those paying fees for membership or other services using a payment card, our website redirects such transactions to a gateway which collects payment card information for processing. TSIA has no access to any payment card information.
We save the contact information of individuals submitting payment, but do not have access to or otherwise store payment and card information.
Through Comments and Forums
Comments on TSIA blog posts, social media posts, or other public forums are collected by TSIA as a form of contact, and our Membership Development, Member Success, or Research teams may conduct follow-ups with this information.Be aware that whenever you publicly disclose information online, that information could be collected and used by others. TSIA is not responsible for any action or policies of any third parties who collect information that users publicly disclose in any such forums on TSIA's website or blog.
We may use information provided to us through comments or other public interactions to follow up with you, but be aware that third parties may also use this publicly available information.
2.2 Anonymous Data We Automatically Collect
If you do not make yourself known to TSIA, you remain anonymous.
If you do not make yourself known to TSIA, your use of our content and services is anonymous. Anonymous data collected includes browsing and download activity on our sites, which will be matched to the information you provide once you make yourself known. Further details on how we collect anonymous data can be found under our cookie policy in Section 6 below.
Examples of Data We Collect
When you access our content online via mobile phone, computer, tablet or any other device:
- IDs or identifiable information of your device.
- Cookies set by third-party data collection tools: Google API’s, Coveo, ClouldFlare, Google GStatic, Hubspot, HS-Analytics, HS-Scripts, HSForms, Addthis, Addthisedge, Bootstrap, Marketo, Vidyard, Google Analytics, Fontawesome,WURLFL.io, Google Tag Manager.
- Pages on the Sites visited.
- Referring websites (websites linking to the Site accessed).
- Your browser version, screen resolution, and operating system.
- IP address from your ISP connection or mobile carrier.
- Amount of time spent on each page of the Site.
- Search inquiries using a Site search function.
- Heatmap showing click activity.

2.3 Information Collected From Third Parties
Through Customer Acquisition Tools
Your information may be supplemented with additional information from third-party vendors such as publicly available information, information about your company, and other information which we may append or match to your record. We may also review and collect biographical information about representatives and contacts from members or prospective members that they post to the Internet.Information we collect includes details about member and non-member organizations and employees, including their contact information (name, address, telephone numbers, and email addresses), job title, and name of employer.
By publicly disclosing information online, that information could be collected and used by others.

2.4 Service Use
We log your interactions with our services and resources
Automated data we collect includes usage of our sites and apps, logins, content downloads, webinar registrations, and views. This data can also include cookies, device information, and IP addresses. See our cookie policy in Section 6 and "How We Use Your Information" in Section 3 for more information.
Data collection by TSIA employees is done through online surveys (using third-party software), email, and phone calls. Access to your personal information is restricted to those employees who need to know that information in order to process it and provide you with a personalized membership experience. These individuals are bound by confidentiality obligations and may be subject to disciplinary action, including employment termination, if they fail to meet those obligations. Event data we collect can include conference and webinars registrations
2.5 Data Retention
PII is retained for a period of five (5) years after the business relationship is no longer active. An "active" business relationship is defined as any interaction between an individual and TSIA, including but not limited to phone calls; website downloads; attendance at TSIA events, both in-person and virtual; and email, including opens and click-throughs. After a period of five (5) years of inactivity, TSIA will erase the PII.
2.6 Public Forums/Third-Party Websites
TSIA’s Sites and affiliated entity websites may have public forums. Any information posted in a public forum is at your discretion; TSIA cannot prevent the public’s access to such information. If you are concerned about the privacy of information in public forums, please do not post any information in them. TSIA and its affiliated entities will obtain your consent before posting any information related to your identity. Examples of public forums are:
- Comments to blogs
- Testimonials (textual and video)
Should you wish to have any public forum data removed, please email privacy@tsia.com or at TSIA’s General Contact Information below with a description of the specific content or information you wish to have removed from the public forum and where it appears. TSIA cannot resolve any issues where the data has displayed outside of its Sites. An example would be a Tweet that was made that displays in a feed on one or another of TSIA’s Sites. TSIA can remove the Tweet from its Sites, but cannot control what Twitter or Twitter users do with the tweet, such as retweeting it.
TSIA frequently links to third-party websites. Any PII disclosed on those websites is outside of TSIA’s control; you should read their privacy policy before providing any PII.
3. How We Use Your Information
How we use your data depends on whether you are a member, non-member, or visitor.
PII Disclosure or Sharing
TSIA and its affiliates may disclose your data/PII:
- To the extent required by law; if we have reason to believe that disclosure will assist in investigations relating to the security and protection of our systems; or in response to search warrants, subpoenas, other judicial or administrative process, national security letters, or other demands that compel the release of PII under applicable law.
- In connection with a sale, merger, reorganization, or other transfer of TSIA’s business (including under bankruptcy proceedings).
- To meet our contractual obligations where a vendor or third party is processing PII on our behalf. This is described further below.

3.1 How We Use Anonymous Data
We use anonymous visitor information to optimize our marketing efforts.
Anonymous data is used to improve your experience with our sites and services. TSIA strives to provide the most compelling content at the right time during your journey with us. Anonymous data may also be used to track the effectiveness of our marketing campaigns.
3.2 How We Use Your Personal Information
We do not sell your information.
TSIA does not sell or rent your personal information to third parties. However, we may sell, transfer, or otherwise share some or all of TSIA's assets in connection with a merger, acquisition, reorganization, sale of assets of our business, or in the event of bankruptcy.
To Stay in Touch and Keep You Informed
By opting into communications with TSIA or sharing your contact information with us, we will keep you up-to-date on services and events that match the interests you've expressed. See more details under "TSIA Communications and Alerts."
To Establish Our Relationship With You
We use personal account information in order to market our services and establish relationships. In addition, your information is used to operate and improve our membership programs and services, obtain payment for membership fees, fulfill your support or other requests and communicate with you, conduct research, and personalize the content and advertisements provided to you.
To Improve Your Membership Experience
The information you provide directly or through use of our services is used to make sure members are getting the most from their experience with TSIA. This includes making recommendations, such as resources to consume and conference sessions or events to attend. We may also use this information to recommend other TSIA services that can benefit your company.We use the information provided by non-members to market TSIA services and make sure you are having the best experience, which will carry over into your membership.
We use the contact information you've provided us with to alert you membership news and important updates as well as ensure a positive user experience.
Video, Photos, Audio, and Streaming of Events
TSIA holds live events at various venues around the world. TSIA and its professional service providers reserve the right to pre-record speaker presentations, record or live stream video, photos, and audio, to record events, post such media to its social channels, website, or mobile app, display feeds on monitors at the conference venues, and create future marketing materials. TSIA, at its discretion, may grant the use of captured videos, recordings, and photographs to exhibitors, sponsors, and speakers with prior approval and appropriate attributions to the TSIA World Conference.
TSIA World session proceedings are available in various formats post-event. Accordingly, to protect speaker privacy and intellectual property, the recording of conference sessions (including audio, video, and photographs) by attendees, exhibitors, sponsors, news organizations, and other businesses is prohibited without prior written consent from the event organizers. Requests for such consent can be directed to events@tsia.com.
By attending a TSIA conference or event, you acknowledge and agree that TSIA may use any recorded media for purposes of display during the Conference, marketing and promotional purposes, and any other lawful purposes in the ordinary course of TSIA's business. TSIA is not responsible or liable in any way for the activities of attendees involving recording or streaming video, pictures, or audio at conference venues.
By attending a TSIA event, you acknowledge that your image may captured by our staff photographers and videographers to be used in future marketing or promotional collateral.
Where Required by Law
TSIA may disclose personal information when required by a subpoena, court order, search warrant, other legal process, requests by law enforcement agencies, or applicable law. Moreover, we may disclose personal information to the extent necessary to maintain the security of our systems, apps, and Sites, resolve disputes, or investigate possible misconduct.
TSIA will cooperate by providing relevant personal information if requested by law enforcement.
3.3 Third-party Services
All third parties who work with TSIA and interact with our users must adhere to the restrictions presented in our privacy policy.
TSIA may partner with third parties for the purpose of delivering products or services that are part of TSIA's offerings. In those cases, it is necessary to convey names and email addresses of users to the third party in order to provide TSIA services. When these third parties receive such personal information, they commit to govern its use and disclosure with privacy practices that are at least as restrictive as TSIA's privacy policy. In those cases, these third parties are under no circumstances permitted to send marketing communications directly to our users with the personal information provided by TSIA, or to use the personal information they receive for any purpose other than the delivery of TSIA products or services, unless, in the use of the product or service, the user elects to enter into a direct business relationship with the third party, opts in to receive marketing communications from the third party, or accepts terms and conditions for the use of the third party's product or service. These third parties have their own privacy policies, which govern their products and services.
3.4 TSIA Webinar Program
Information collected from jointly-offered webinars co-presented or co-hosted between TSIA and a sponsoring partner may be used by that partner in accordance with its privacy policy.
TSIA may partner with other companies to jointly promote products or services during live webinars. If you specifically express interest in a partner-sponsored webinar, we may share contact information collected during the registration process with our joint promotion partner(s). TSIA limits the duration of the business partners' use of the information we collect. Their use of the information will be in accordance with their own privacy policies. If you sign up for a TSIA webinar that was promoted by a partner, you will become part of the TSIA database and may receive notices of upcoming webinars of similar topics. If you do not wish for your information to be shared in this manner, you may opt to not register for a jointly-offered webinar.
We do not share your information with business partners without your consent. You always have the option to decline interaction with TSIA partners and respective communications.
TSIA does not share data about attendees with business partners unless: (1) you opt in to such sharing via an event registration form, or (2) you attend a TSIA conference and allow TSIA or any of its designees to scan your attendee badge. At any point after registration, if you do not wish for your information to be shared in this manner, you may choose to opt out of event communications and/or elect not to have your badge scanned at TSIA events. If you choose to share your information with business partners in the manners described above, your information will be subject to the business partners' respective privacy policies.
4. Internet Advertising
TSIA does not display or deliver third-party advertisements on our Sites, but we do advertise our services on other sites. We do not provide your information to these advertisers.
TSIA does not deliver third-party online advertisements on our websites, but we advertise our programs and services on others' websites. Please familiarize yourself with those website operators' or network advertisers' privacy policies to understand their practices relating to advertising. TSIA does not provide any information we have collected about you, or relating to your usage of any TSIA Sites to advertising website operators or network advertisers.
Some advertising networks we use may be members of the Network Advertising Initiative (NAI). Individuals [SW1] may opt out of targeted advertising delivered by NAI member ad networks by visiting www.networkadvertising.org.
5. Do Not Track
TSIA does not track its customers over time across third party websites to provide targeted advertising and therefore does not respond to Do Not Track (DNT) signals. However, some third party sites do keep track of your browsing activities when they serve you content, which enables them to tailor what they present to you. If you are visiting such sites, your web browser allows you to set the DNT signal so that third parties (particularly advertisers) know you do not want to be tracked.
Third parties that TSIA embeds in our website may set cookies on a user’s browser and/or obtain information about the fact that a web browser visited specific TSIA.COM content from a certain IP address. Third parties cannot collect any other personally identifiable information from TSIA's website.
6. TSIA Communications and Alerts
6.1 Emails, alerts, and other communications
You will receive email communication from TSIA only if you have opted in. You can change your communication preferences in your account profile on the applicable Site.
By opting in to receive TSIA communications or alerts, you agree to receive on occasion other correspondence from TSIA related to topics and other TSIA news and information that you consented to receive during subscription, registration, sign up, verbal communication, or other online action. In addition, we may contact you regarding your membership status. This type of information is for our internal use and is shared externally only in anonymous, aggregated form for generalized user analysis, or to enable third-party agents to send emails to you on our behalf. You will be contacted by email or otherwise only by TSIA unless you have also expressed interest in a partner's event. See more details on how we share information with our partners under "TSIA Conferences and Events" in Section 3 above.
Our website also includes a feature that enables TSIA to share links to its content through email at our users' requests. The email address(es) that you supply in connection with this service will be used only to send the requested content. They will not be reused for any purpose. By making use of this feature, you are agreeing that you have permission to use the email addresses provided and that they have been obtained in a manner compliant with applicable anti-spam laws, including the federal CAN-SPAM Act.

We offer marketing preferences for you to control how we communicate offers and other information to you. You can adjust your communication preferences at any time by visiting https://www.tsia.com/email-preferences.
7. Use of Cookies and Other Technologies
7.1 Cookies
We make use of cookies to maintain an easy-to-use web experience, but you may disable them in your browser. These cookies do not grant us access to your personal information.
We may use (or we may contract with service providers to use) various technologies to collect information about your activities on our Sites.
To make TSIA Sites work properly, facilitate access to our Sites, and personalize your experience, we may assign your computer or device one or more "cookies." A cookie is a small data file that our Sites and app save on your computer or mobile device when you visit our Sites, use the App, respond to surveys, or participate in polls. It enables our Sites to remember your actions, browsing activities, favorite content, and preferences (such as clicking "Remember me" during login). Whenever you sign into our Sites or the App, we will record your user ID in a cookie file on your computer or device.
Cookies do not give us access to your PII. Information collected by cookies may include:
- Your browser or operating system
- Your manner of connecting to the Internet (including the type of device you are using
- Your Internet protocol (IP) address (not associated with a particular individual)
- Data relating to malfunctions or problems occurring when you use TSIA Sites
- App usage for statistical and research purposes
Additionally, we may collect information about other software on your device for the limited purpose of protecting your security or improving your online experience.
We use a combination of Google Analytics, marketing automation, and cookies on our Sites that identify your computer to help us analyze traffic patterns on our Sites as well as to provide you with a better experience by showing you content that matches your interests, improving content, and making the Sites easier to use.
Through the use of a cookie, TSIA may also automatically collect information about your online activity on our Sites, such as the web pages you visit, the links you click, and the searches you conduct.
Google Analytics uses cookies to help TSIA analyze how visitors use its Sites. The information generated by the cookies about your use of TSIA Sites includes your IP address, and will be transmitted to and stored by Google on its servers.
Google will use this information for the purpose of evaluating your use of our sites, creating reports on website activity, and providing other services relating to Internet usage. Google may also pass this information onto third parties when required to do so by judicial or administrative process or otherwise to the extent required by law, or when such third parties process the information on Google's behalf.
By using one of our Sites, you consent to the processing of data about your visit by Google in the manner and for the purposes set out above.
If you so choose, you can opt out by turning off cookies in the preferences settings in your browser, or by downloading and installing the Google Analytics Opt-Out Browser Add-On from http://tools.google.com/dlpage/gaoptout.
TSIA’s use of cookies conforms to industry standards. Should you wish to not have cookies enabled when using our Sites, you can adjust your browsers settings accordingly. However, this may cause issues in accessing information where authorization is required. Additionally, you can set your user preferences on your profile on our Sites to control how cookies are set.
7.2 Other Technologies
We use web beacons/clear GIFs/pixel tags to track how users are interacting with our content. The information we gather is used solely to monitor the effectiveness of our communications and does not track your personal information.
TSIA may use standard Internet technology, such as web beacons (also called "clear GIFs" or "pixel tags"), locally stored objects (often referred to as "flash cookies"), and other similar technologies, to deliver or communicate with cookies and track your use of our Sites and content presented via the Sites. TSIA may also include web beacons in email messages or newsletters to determine whether messages have been opened and acted upon. The information TSIA obtains in this manner enables customization of the programs and services TSIA offers, and measures the overall effectiveness of TSIA’s online content and advertising campaigns.
7.3 Information Used by Third-Party Sites and Services
TSIA partners may use cookies, but TSIA does not have access to this information. Please read their privacy policies to learn more.
Third parties, such as vendors, advertising entities, and business partners, may use cookies and other technologies (such as web beacons) to collect information about your online activities. The purposes for collecting this information includes: to measure usage of our sites; to analyze, modify, and personalize advertising content on our sites; and to provide ads about goods and services we hope will be of interest to you. We do not have access to or control over cookies or other features these third parties may use, and the information practices of these third parties are not covered by this privacy policy. Some of these third parties may be network advertisers that offer you the option of not having this information collected.
7.4 Links to Third-Party Sites
TSIA is not responsible for your experience should you click a link to an external site, such as a partner or sponsor.
You may find links to other companies on our site with whom we have a relationship. TSIA is not responsible for the privacy practices of these third parties. We encourage you to read their privacy statements, as they may differ from ours.
8. Data security
TSIA takes data security very seriously and has implemented various physical and electronic safeguards to keep your information secure.
TSIA utilizes industry-standard administrative, physical, and technical safeguards to protect personal information received from our users and website visitors. TSIA will protect PII by reasonable security safeguards against loss or theft, as well as unauthorized access, disclosure, copying, use, or modification. Safeguards for TSIA’s internal systems and infrastructure include transport layer security or secure sockets layer protocols to protect and encrypt PII in transit, firewalls and data encryption at rest. These methodologies, unfortunately, cannot 100% guarantee that Internet transmissions will be protected, secured, or not otherwise intercepted.
TSIA is committed to maintaining reasonable and appropriate administrative, physical, and technical safeguards to:
- Provide assurances of the integrity and confidentiality of personal information.
- Protect against any reasonably anticipated threats or hazards to the security or integrity of personal information, and unauthorized uses or disclosures of personal information.

We use a payment gateway for the collection of payment card information. That payment gateway is responsible for the protection of payment card information under the Payment Card Industry (PCI) Data Security Standard.
9. Online Payments
All sales are final. Please review your membership contract for information on early termination guidelines.
All payments made via the online payment system are final. Your contract or invoice outlines the cancellation, early termination, or refund options offered on the services purchased. Please discuss any questions you may have prior to making the payment. TSIA does not collect any information submitted during the payment process. The payment processor for TSIA is PCI compliant.

11. Data Privacy Framework (DPF) Principles and Dispute Resolution
TSIA complies with the EU-U.S. Data Privacy Framework (EU-U.S. DPF) and the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) as set forth by the U.S. Department of Commerce. TSIA has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (EU-U.S. DPF Principles) with regard to the processing of personal data received from the European Union and the United Kingdom in reliance on the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF. TSIA has certified to the U.S. Department of Commerce that it adheres to the Swiss-U.S. Data Privacy Framework Principles (Swiss-U.S. DPF Principles) with regard to the processing of personal data received from Switzerland in reliance on the Swiss-U.S. DPF. If there is any conflict between the terms in this privacy policy and the EU-U.S. DPF Principles, and/or the UK Extension to the EU-U.S. DPF and/or the Swiss-U.S. DPF Principles, the Principles shall govern. Liability for onward transfers. TSIA uses a limited number of third-party service providers to assist us in providing our services to customers. These third-party providers assist with the transmission of data and provide data storage services. These third parties may access, process, or store personal data in the course of providing their services. TSIA maintains contracts with these third parties restricting their access, use and disclosure of personal data in compliance with our EU-U.S. Data Privacy Framework (EU-U.S. DPF) and the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) obligations, and TSIA may be liable if they fail to meet those obligations and we are responsible for the event giving rise to the damage.
With respect to PII received or transferred pursuant to the EU-U.S. Data Privacy Framework (EU-U.S. DPF) and the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF), TSIA is subject to the regulatory enforcement powers of the Federal Trade Commission (hereafter “FTC”).
In compliance with the EU-U.S. Data Privacy Framework (EU-U.S. DPF) and the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF), TSIA commits to resolve complaints about your privacy and our collection or use of your PII. Dispute Resolution. TSIA has further committed to referring unresolved privacy complaints under the EU-U.S. Data Privacy Framework (EU-U.S. DPF) and the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) to the independent recourse mechanism offered by JAMS, an alternative dispute resolution provider located in the United States. TSIA is obligated to arbitrate claims and follow the terms as set forth in the DPF Principles at https://www.dataprivacyframework.gov/framework-article/ANNEX-I-introduction, provided that an individual has invoked binding arbitration by delivering notice and following the procedures and subject to conditions set forth in Annex I.

12. California Consumer Privacy Act (CCPA) and Information Dispute Resolution
TSIA is also subject to the CCPA, the California consumer privacy law enacted in 2018, which extends to California consumers (individuals) various rights that align to a significant degree with the rights granted to most European residents under the GDPR with respect to their personal data/information. If you are a consumer based in California, the rights you have include:
12.1 Right to Disclosure
- 12.1.1 Right to request TSIA to disclose to you: (a) the categories of personal information collected by us; (b) the categories of sources from which the personal information is collected; (c) the business or commercial purpose for collecting or selling personal information (but we don’t sell personal information); (d) the categories of third parties with whom we share personal information; (e) the specific pieces of personal information we have collected about you, the consumer—in all cases upon a verifiable consumer request (“VCR”).
- 12.1.2 If we receive a verifiable consumer request (VCR) to access personal information, we will promptly take steps to disclose and deliver, free of charge, the personal information required by law, which may be delivered by mail or electronically. If delivered electronically, the information shall be in a portable, and if technically feasible, readily usable format permitting transfer by the consumer. We are not required to respond to your VCRs more than twice in a 12-month period. You can make a VCR either by email to privacy@tsia.com, to TSIA’s mailing address set forth in the General Contact Information section of this Policy or to the following toll free number in the US (833) 333-8742. We are required to disclose and deliver the required information to you free of charge within 45 days of receiving a VCR. The 45-day time period can be extended once by an additional 45 days when reasonably necessary, provided we give you notice during the first 45-day period. The disclosure will cover the 12-month period preceding our receipt of your VCR. The disclosure must be in writing and delivered by mail or electronically at your option, in a readily usable format that facilitates onward transfer of the information by you.
- 12.1.3 We need not retain any personal information collected for a single, one-time transaction if we do not sell or retain the information nor use it to reidentify or link data maintained as your personal information.
- 12.1.4 We are required to disclose at or before the point of collection of personal information: (a) the categories of personal information to be collected, and (b) the purposes for which such categories will be used, and we believe that this Policy achieves those goals. Additional categories of personal information may not be collected or used without providing you with notice.
12.2 Right to Deletion
- 12.2.1 We are required to disclose to you that you have the right to have your personal information deleted.
- 12.2.2 If a deletion VCR is received by us, we will delete your personal information from our records and direct any of our service providers to which we have provided such information to delete your personal information from their records
- 12.2.3 But bear in mind that we are not required to comply with your VCR to delete personal information if we need to retain the personal information for the following purposes: (a) to complete the transaction for which personal information was collected, such as providing a product/good or service requested you, or which is reasonably anticipated within the scope of our business relationship with you, or to perform a contract with you; (b) to detect security incidents, protect against malicious, deceptive, fraudulent or illegal activity, or prosecute those responsible for activity; (c) to debug to identify and repair errors that impair intended functionality; (d) to exercise our right to free speech or ensure the right of another consumer to exercise free speech or another right provided by law; (e) to comply with the California Electronic Communications Privacy Act; (f) to engage in public or peer-reviewed scientific, historical or statistical research in the public interest otherwise subject to applicable ethics and privacy laws, if the research would be seriously impaired by our compliance with your request; (g) to enable solely internal uses reasonably aligned with consumer expectations based on our business relationship with you; (h) to comply with a legal obligation; or (i) otherwise to use personal information internally in a lawful manner compatible with the context in which you provided the information. Since we function as a private arbitral/judicial body, our requirement to retain case information intact often means that we are obligated to retain case-related personal information.
12.3 Consumer Rights: Sale of Personal Information or Disclosure for a Business Purpose:
- 12.3.1 “Do not sell my information”. TSIA discloses your information to third parties in the manner outlined in this Policy. Under CCPA, you have the right to opt out of this disclosure when the exchange of your information constitutes a sale.
- 12.3.2 You do have the right to disclosure of categories of personal information about you that are disclosed for a business purpose, which we believe are set forth in this Policy.
- Our obligations to you under this law will not prevent our ability to: (i) comply with federal, state or local laws; (ii) comply with civil, criminal or regulatory inquiry, investigation, subpoena or summons; (iii) cooperate with law enforcement agencies; (iv) exercise or defend legal claims; (v) use consumer/personal information that is deidentified or in the aggregate; (vi) collect personal information to extent every aspect takes place outside of California; (vii) avoid violation of an evidentiary privilege under California law, or provide personal information to a person covered by such a privilege.
12.4 Non-Discrimination
- 12.4.1 The CCPA requires that no subject business shall discriminate against you if you exercise your rights under this law, including by: (a) denying goods or services to you/the consumer; (b) charging different prices or rates for goods or services, whether through discounts, other benefits or imposing penalties; (c) providing a different level of goods or services, or suggesting that you will receive a different price, rate, level or quality of goods or services.
